These Terms of Use (“Terms”) govern your use of the Instinct mobile application (“App”) and any related services provided by Instinct (“we”, “us”, “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
These Terms do not affect your statutory rights as a consumer under the laws of your country of residence, including the Consumer Rights Act 2015 (UK) or the Consumer Rights Act 2022 (Ireland).
Instinct provides personalised daily enrichment activities (“Drives”) for dogs, based on breed instinct profiles and behavioural data. The App uses AI to match activities to your dog’s needs.
Instinct is an enrichment and games app. It is not a dog training programme, veterinary service, or behavioural therapy tool. The content in the App is not a substitute for professional veterinary advice, diagnosis, or treatment, or for the services of a qualified animal behaviourist.
If you have concerns about your dog’s health, behaviour, or wellbeing, please consult a veterinary professional.

Instinct provides general guidance, but every dog is different. You know your dog best.
You must be at least 16 years old to create an account and use the App. If you are under 18, you confirm that you have the consent of a parent or guardian.
To use the App, you must create an account using email, Apple Sign-In, or Google Sign-In. You may delete your account at any time from the Settings screen. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
You retain ownership of any content you submit to the App, including photos, ratings, and notes. By submitting content, you grant Instinct a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely for the purpose of providing and improving the service.
You agree not to upload content that is unlawful, harmful, offensive, or inappropriate.

Instinct may offer premium features via in-app subscriptions processed through the Apple App Store or Google Play Store.
Before purchasing a subscription, you will be shown the price, billing frequency, and renewal terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
You have the right to cancel a subscription within 14 days of purchase or renewal for a full refund, in accordance with applicable consumer protection law. To cancel, use the subscription management settings in your app store account, or contact us at hello@instinct-app.com.
Refunds for cancellations outside the 14-day period are handled by the relevant app store in accordance with their policies.
All content, features, and functionality of the App — including text, graphics, logos, activity descriptions, algorithms, and software — are owned by Instinct and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our written consent.
Instinct uses AI to personalise activity recommendations based on your dog’s breed, instinct profile, and activity history. AI-generated recommendations are suggestions only and may not be suitable for every dog. You should always use your own judgement before starting any activity.
The App is provided on an “as is” and “as available” basis. While we take reasonable care to ensure that the content in the App is accurate and up to date, we do not guarantee that it will be error-free, uninterrupted, or suitable for any particular dog.
Activity recommendations are generated with the assistance of AI and are intended as general enrichment suggestions. They are not tailored clinical or veterinary advice.
This disclaimer does not affect your statutory rights under the Consumer Rights Act 2015 (UK) or equivalent legislation in your jurisdiction. Under those rights, digital content must be of satisfactory quality, fit for purpose, and as described.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
Subject to the above, to the maximum extent permitted by law:
You agree to indemnify and hold Instinct harmless from any claims, losses, or damages (including legal fees) arising from your misuse of the App, your breach of these Terms, or any activity you undertake with your dog based on App content where you have not followed the safety guidance provided.
We reserve the right to suspend or terminate your account if you breach these Terms. We will notify you in advance where reasonably practicable. Upon termination, your data will be handled in accordance with our Privacy Policy.
We may update these Terms from time to time. If we make material changes, we will notify you within the App before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
If you are a resident of the United Kingdom, these Terms are governed by the laws of England and Wales, and any disputes shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
If you are a resident of Ireland, these Terms are governed by the laws of Ireland, and any disputes shall be subject to the non-exclusive jurisdiction of the Irish courts.
Nothing in these Terms affects your statutory rights as a consumer in your country of residence.
